1. What Information Do We Collect?

A. Personal Information You Disclose to Us

Summary: We collect personal information you have provided to us.

We collect personal information that you voluntarily provide to us when registering Honest, when you are forming a User Agreement, when you are forming a User Contract, when you are creating a User Profile, when you are making or receiving a payment, expressing an interest in obtaining information about us or our products and services, when participating in activities on the Services (such as posting messages in our online forums or entering competitions, contests or giveaways) or otherwise contacting us.

The personal information that we collect depends on the context of your interactions with us, with the other users of the website, with our Services, the choices you make and the products and features you use. Depending on the type of profile you are creating (i.e. Buyer Profile, Seller Profile), or certain service you are requesting or offering, the amount of the personal information we collect may include some or all of the following:

I. Publicly Available Personal Information

We may collect first name, maiden name, last name, and nickname; ID; driver’s license number; current and former address; phone numbers; email addresses; business email; business phone number; business entity filings, corporate affiliations, and business associates; court records, lien filings, foreclosures, and UCC filings (forms filed by a creditor to give notice of interest in debtor’s personal property); family member names and their related information; government licenses, professional licenses, hunting/fishing permits, and weapons permits; and other similar data. 

II. Personal Information Provided by You

We collect app usage; taxation, pension, and maternity leave; CV and other job application data such as background checks; work performance, salary, bonuses, and disciplinary actions; financial information (credit card number, purchase history, invoices); passwords; and other similar data.

III. Payment Data

We collect data necessary to process your payment if you make purchases, such as your payment instrument number (such as a credit card number), and the security code associated with your payment instrument. IV. Social Media Login Data

We may provide you with the option to register using social media account details, like your Facebook, Twitter or other social media account. If you choose to register in this way, we will collect the Information described in the section called “HOW DO WE HANDLE YOUR SOCIAL LOGINS” below. Failure to provide your real social media account (i.e. logging in via a Facebook account that has been created by incorrect credentials) will be a breach of the User Agreement.

All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.

B. Information automatically collected

Summary: Some information (i.e. IP number, your location) is collected automatically when you visit our Services.

Honest.NYC automatically collects certain information when you visit, use or navigate our Website. This information does not reveal your specific identity (i.e. your name or contact information) but may include device and usage information, such as your IP address, browser, and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Website and other technical information. This information is primarily needed to maintain the security and operation of our Website, and for our internal analytics and reporting purposes.

I. Online Identifiers

We collect devices; applications; tools and protocols, such as IP (Internet Protocol) addresses; cookie identifiers, or others such as the ones used for analytics and marketing; Radio Frequency Identification (RFID) tags; device’s geolocation; and other similar data.

C. Information collected from other sources

Summary: We may collect limited data from public databases, marketing partners, social media platforms, and other outside sources.

We may obtain information about you from other sources, such as public databases, joint marketing partners, social media platforms (such as Facebook), as well as from other third parties. Should we receive a request from you we will inform you about the source of information and the type of information and the type of information we have collected about you within a reasonable period after obtaining the personal data, but at the latest within one month of your request regarding the information we have collected from other sources. 2. HOW DO WE USE YOUR INFORMATION?

A. To Facilitate Account Creation and Login Process

If you choose to link your account with us to a third party account (such as your Google or Facebook account), we use the information you allowed us to collect from those third parties to facilitate account creation and logon process for the performance of the contract. See the section below headed “HOW DO WE HANDLE YOUR SOCIAL LOGINS” for further information.

B. To Send You Marketing and Promotional Communications

We and/or our third-party marketing partners may use the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. You can opt-out of our marketing emails at any time (see the “WHAT ARE YOUR PRIVACY RIGHTS” below).

C. To Send Administrative Information to You

We may use your personal information to send you product, service and new feature information and/or information about changes to our terms, conditions, and policies.

D. Fulfill and Manage Your Orders

We may use your information to fulfill and manage your orders, payments, returns, and exchanges made through the Services.

E. To Post Testimonials

We post testimonials on our Services that may contain personal information. Prior to posting a testimonial, we will obtain your consent to use your name and testimonial. Where we have entered into a contract with you or where two users have entered into a contract with each other through Honest.nyc, we may process your personal information to fulfill the terms of our contract.

We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).

E. Vital Interests

We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.

To be more specific, we may need to process your data or share your personal information in the following situations:

F. Vendors, Consultants and Other Third-Party Service Providers

We may share your data with third party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. 5. DO WE USE GOOGLE MAPS?

Summary: Yes, we use Google Maps for the purpose of providing better service.

By using our Maps API Implementation, you agree to be bound by Google’s Terms of Service. You agree to allow us to obtain or cache your location. You may revoke your consent at anytime. We use information about location in conjunction with data from other data providers.

6. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

Summary: If you choose to register or log in to our services using a social media account, we may have access to certain information about you.

Honest.nyc may offer you the ability to register and login using your third-party social media account details (i.e. LinkedIn logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile Information we receive may vary depending on the social media provider concerned, but will often include your name, e-mail address, friends list, profile picture as well as other information you choose to make public.

We will use the information we receive only for the purposes that are described in this privacy policy or that are otherwise made clear to you on the Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. We strongly advise that you review their privacy policy to understand how they collect, use and share your personal information, and how you can set your privacy preferences on their sites and apps.

7. WHAT IS OUR STANCE ON THIRD-PARTY WEBSITES?

We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services or applications that may be linked to or from the Services. 8. HOW LONG DO WE KEEP YOUR INFORMATION?

Summary:  We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this policy will require us keeping your personal information for longer than 1 year past the termination of the user’s account or 1 year past the termination of the final User Contract the user entered into while using Honest.nyc, whichever comes last.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

9. HOW DO WE KEEP YOUR INFORMATION SAFE?

Summary:  We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. 10. DO WE COLLECT INFORMATION FROM MINORS?

Summary:  We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you would at any time like to review or change the information in your account or terminate your account, you can:

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our User Agreement and/or comply with legal requirements.

B. Cookies and similar technologies

Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. C. Opting out of email marketing

You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below. You will then be removed from the marketing email list – however, we will still need to send you service-related emails that are necessary for the administration and use of your account. To otherwise opt-out, you may:

12. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy policy.

  • The categories of sources from which the personal information is collected.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. 3.  Exercising Access and Deletion Rights

Only you, or a person or business entity registered with the California Secretary of State that you authorize to act on your behalf (an “authorized agent”), may make the requests set forth above. You may also make a request on behalf of your minor child.  

The request should include your contact information and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. In addition, you should provide sufficient information (including information that reasonably enables us verify the identifying information we currently maintain about you) that allows us to reasonably verify that you are the person about whom we collected the personal information or an authorized representative.

We will respond to consumer requests in a reasonably timely manner. If we require extra time to respond, we will inform you of the reason and extension period in writing. In order to protect the security of your personal information, we will not honor a request if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. The method used to verify your identity will depend on the type, sensitivity and value of the information, including the risk of harm to you posed by any authorized access or deletion. Generally speaking, verification will be performed by matching the identifying information provided by you to the personal information that we already have. 

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request (and will not be made more than twice in a 12-month period). If we cannot comply with a request, or cannot fully comply with a request, the response we provide will also explain the reasons we cannot comply.

4.  Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights, including, but not limited to, by:

  • Denying you goods or services.
  • Charging you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Providing you a different level or quality of goods or services.
  • Suggesting that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

5. Minors

We do not knowingly engage in activity with people under the age of 18, nonetheless if you are under 18 years of age, reside in California, and have a registered account with the Services, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from our systems.

14. DO NEVADA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

Summary:  Yes, if you are a resident of Nevada, you are granted specific rights regarding access to your personal information.

Under Nevada law, certain Nevada residents may opt-out of the sale of “personally identifiable information” for monetary consideration to a person for that person to license or sell such information to additional persons. “Personally identifiable information” includes first and last name, address, email address, phone number, Social Security Number, or an identifier that allows a specific person to be contacted either physically or online.

We do not engage in such activity; however, if you are a Nevada resident who has purchased or leased goods or services from us, you may submit a request to opt-out of any potential future sales under Nevada law by emailing [email protected] . Please note we will take reasonable steps to verify your identity and the authenticity of the request. Once verified, we will maintain your request in the event our practices change.

15. DO WE MAKE UPDATES TO THIS POLICY?

Summary:  Yes, we will update this policy as necessary to stay compliant with relevant laws.

We may update this privacy policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy policy frequently to be informed of how we are protecting your information.

16. WHAT HAPPENS WHEN HONEST TRANSFERS DATA BETWEEN COUNTRIES?

Summary: Currently our servers are located in the US, however, we may establish servers outside the US at any time with or without notice to the Users. Data protection laws vary among countries, but we apply the same level of protections regardless to the extent allowed by the applicable law.

Currently, our servers are located in the United States and regulated accordingly. However, we may establish servers outside of the United States at any time, with or without notice to the Users. When we maintain servers around the world your information may be processed on servers located outside of the country where you live. Data protection laws vary among countries, with some providing more protection than others. Regardless of where your information is processed, we apply the same protections described in this policy. 

When we receive formal written complaints, we respond by contacting the person who made the complaint.
